Can the auto dealer keep the hold check if the deal didn't go thru coz car totaled?
Bought a car and gave the hold check for $1600 for the down payment plus $400 cash, drove the car out, within a week the car was totaled, not our fault. The finance company says in the mean time the deal is dead because they didn't have my credit app. The auto dealer deposited the check anyway saying it was a done deal, the finance company says no it wasn't. The dealer wants the sale price for the car which includes title, license (even though DMV confirmed the dealer owns the car) and insurance is only willing to pay $6000. The dealer wants to keep our hold check. Anyone know what I can do. I am at a loss!
Update:
Interestingly enough, we contacted an attorney. We found out that a deal had been struck between the dealer and insurance company leaving us out of the settlement. In fact, we were not liable and had to have been made whole as if the transaction never took place. They were only entitled to the price of the car and not the "extras" such as title, license and etc. because it was never our car. I was hoping someone familiar with Bushing law would have spoken up since I was looking for advice.
It is funny that you interpreted us as attempting to "screw" someone when in fact the same was happening to us! Word to the wise, be careful when it comes to insurance and dealers, know your rights!!
Last update! I got my full amount back from the dealer. Don't forget to fight for your rights and pray!!
