ME VS CAR DEALER VS CAPITAL ONE WOW INCREDIBLE!?
ok so heres the scenerio. 8 days ago i bought a 2008 mazda cx7 because i got a preapproval letter from capital one. so i went in looked at some cars and they said i can get approved for the mazda. they wanted some money down and i said i didnt have none. so they said how do you expect to buy a car with no money down. i said i dont know but im not giving nothing down. so he said ok let me see what i can do. so hours passed and he said i got you approved i said great. so he sent me to the financial person office. and worked out the numbers . mind this i traded in a chevy impala that i owed 5000 and they said they would make the payoff on it. so i said ok so he showed me the contract i saw the payments they were kinda high but it was ok. they said i only had to give 500 for the taxes im like what the hell i thought the taxes were included in the car he said just give me a blank check and ill hold it for 30 days that has the value of 500 on it.im like i dont have checks on me ill bring you one soon he said no problem. im not giving jack cause last time i did that i lost all my money and another dealer said i wasnt approved. so he let me drive off with the car and a couple days later he told me to send him proof of pay residence contacts and so on . so i did now today i get a call from capital one saying they need more proof and that the loan is not finalized. so i call the dealer and tell them how are you going to say im approved when capital one says im not. there like but you are!!! im like no im not if they need more proof. then i told them i want my old car back and i dont want the mazda back. and there like tough luck we are not paying off your old car so that will be repo 1 and the mazda if you dont agree to the contract will be repo 2.then i call capital one and they said they cant put a repo on car one cause since they havent payed it off im still the owner. and on the mazda i would have to give it back to the dealer cause the loan isnt finalized but that they cant put a repo on my credit because there isnt no loan. if i dont send the needed proof. im just tired of all this its a stress on me and my pregnant wife but i dont want to stay carless. so what are my options. i think the dealer is telling me im approved so they can just get paid. can i get my old car back? if capital one says that the loan still needs more documentation. i also told capital one that i cant afford the monthly payments. and they said no problem that they will cancel the pending auto loan,i think im being pressured by the auto dealer they said they still have the car and there not gonna give it to me or pay it off .that there gonna let it get repoed and if i dont want the mazda that it will be repoed too. but capital one says the loan isnt finalized till i send the needed proof. plus i already canceled the deal with capital one they said it was ok cause the loan wasnt full approved yet, and to take the car back to the dealer . and that they cant put two repos on my credit ; cause i still own the chevy since there not gonna make the payoff, but the dealer doesnt wanna give me my old car back.

QUESTION TO HONEST and RESPECTABLE Auto Dealers!!!?
We r independent dealership and facing some issue with another dealership. Sold to them few cars, HAVE A BILL OF SALE ON THAT. Some dealers will say we didn't sell the cars, we consigned them. To do that we should have a consignment agreement, correct? If it doesn't exist - how would u call that? The very first car is registered to the owners name (she drives it) THAT dealership asked us to wait for the payment, until they receive the check from financing company. We agreed on that, but indicated that in Bill of Sale.Of course decision was built on trust. On second car was pretty much same scenario but we got the check for the car in exchange for the title and signed statement on this transaction. When the agreed date came check was dishonored. We still don't see our money. Need advice how the recover the funds??? Talked to some attorneys but seeking for advice from the dealers who dealt with such issue before! I know is common practice between the dealers. Any helpful advice will be highly appreciated. Chances to go against their Bond??? Thanks! They asked us to wait for the money, until they get paid by the financial company who financed their customer. The thing is their are not some random dealers we have never seen before. We knew them, but didn't know they are in big financial problem. When they received those checks and time came to pay us they used money to pay their own bills and neglected us and our agreement. Normally you will never sign the title over until u get paid, U R CORRECT, but this transaction was based on trust, they had the customer but didn't have enough to pay us up front.
