The Magnuson Moss Warranty Act: Fighting For the Consumer
We've all been sold defective merchandise at one time or another and at the very least it can be a frustrating experience, especially when the company that sold it to you won't take responsibility for the item. Of course it's one thing to buy a defective globe light from a store but to spend thousands of dollars on a brand new car and have things go wrong is a completely different story. Thankfully there are laws in place that protect us if we buy a defective or "lemon" vehicle.
The Magnuson Moss Warranty Act holds companies responsible to the warranties they right on all products over the price of $25. If a written warranty is provided then the seller will be held liable for any and all defects on the car that was not put there by the consumer. It also requires companies to write the warranties in clear and concise terms so that the consumer can readily understand what is covered by the warranty and what is not.
The Magnuson Moss Warranty Act was originally put in place to provide customers with a way of learning what a warranty covers so that they know what to expect. It increases customer satisfaction and makes it clear what companies and buyers are responsible for. The Act was also meant to create competition in the market place based on warranty coverage. Buyers could now shop around and find the best warranty and price for a vehicle that best suited them.
The Magnuson Moss Warranty Act supports the Lemon Laws by holding dealers and manufacturers to the warranties that they create. If a defective vehicle is sold to a consumer the company that sold the vehicle must do anything and everything to fix the problem. If the problem cannot be fixed then the Act states that the consumer has the right to a replacement vehicle or a full refund. Legal fees were also built into the law stating that if a company has not done everything in its power to fix the problem and it is found liable, that it will also be responsible for all legal fees for lemon law attorneys in California, including the buyer's.
