The California Lemon Law: When It Applies For Used Cars

The California Lemon Law was made to protect buyers from purchasing a problematic car. In the event that you are sold a 'lemon, ' the dealer is responsible for refunding your money in full. This includes the initial payment, money spent on repairs, and even money that you spent on additional costs such as rentals or towing fees. You also have the option of getting a replacement car. However, the California Lemon Law is used more like a guideline in court cases which can get pretty messy. By knowing what you are entitled to under the California Lemon Law, you can protect yourself by implementing the law.

So, something goes wrong with your car while it is still under warranty. You do not have the right to ask for a full refund just yet! The California Lemon Law states that the manufacturer has a "reasonable" number of times to fix the problem and the "reasonable" chance to do so. If the problem still persists, then you can invoke the California Lemon Law and get a refund. In regards to a series of different problems, an extended amount of time in the shop would also qualify you for reimbursement. What qualifies as "reasonable" under the California Lemon Law is confusing. This is because it varies depending on the defect. Normally, four is considered a reasonable number of shop visits in regards to the same problem. If the problem is something serious or dangerous, such as faulty breaks, less visits are required. For several different problems, an accumulative of 30 days in the shop during the warranty period may be considered excessive enough the use the California Lemon Law to get a full refund.

The California Lemon Law applies to both new and used vehicles and even to trucks, SUVs, vans and motor homes. It is important to remember however, that the California Lemon Law does not apply if the damages were caused by the owner during the warranty time. You cannot get a refund or even have your car fixed because of a fender bender you got into! If you feel you fall under the California Lemon Law and the manufacturer will doesn't reimburse you, then you need to gather all receipts and evidence.

Remember that the California Lemon Law is here to protect you, even if many manufacturers ignore it in practice. By knowing what the law entitles you to, you can effectively negotiate with the car manufactures and hopefully avoid a messy court case while still getting a full refund for your lemon car.
