Used Car Lemon Law Provides Protection to Automobile Consumers
Buying a car, new or used, is a big deal for many consumers. It is one of those purchases that you really plan and save up for since it is considered to be an investment. However, when it comes to used automobiles, these usually come with limited warranties. Such warranties do not provide protection for the consumer in case the used car is not able to meet the performance and reliability standards. Because of this reality, the used car lemon law was legislated. Through this law, consumers now have a legal protection in case they find themselves unwittingly buying a defective vehicle. This law is covered by the Magnuson-Moss Warranty Act, which was put in effect in 1975 in order to protect consumers who purchase used products. Cars are not the only ones covered by this law, motorcycles and RVs are included as well.
Each of the fifty states has a used car lemon law in place and each has different state statutes. It is important to know the statutes of your local lemon law so that you are guided in case you decide to invoke it against a manufacturer. State lemon laws differ in varying degrees. However, the basis tenets of this law is that the consumer should have purchased a defective automobile which remains unable to perform properly despite multiple attempts at repairing whatever defect it has. The vehicle should also have substantial defects that can impair its value, use, or safety. Under the used car lemon law, if a vehicle has undergone repair for four times and still remains defective, then it is considered a lemon.
Filing a case under the used car lemon law requires proper documentation of all repairs that the vehicle has undergone since the time of your purchase. Also, the manufacturer should have been informed of such defects and given a chance to repair these defects. By doing this, you will have a strong case if you decide to take your problem to court by filing a suit. Once you suspect that you bought a lemon vehicle, do some research on your local lemon law so that you can make an informed decision and choose the best action regarding your case. It is also advisable to seek the advice of an attorney before filing a case.

i bought a used nissan altma with 100k for 5500 bucks two days ago in massacusetts and check engne light came?
i bought a used nissan altma 2002 with 100,000 miles fo 5500 bucks.... iput a dwnpayment on car fr 3 grand and signed no paperwork until ten days later when i brought te oher 2500 hundred to them...now the car wasnt registeredso te dealer put his dealer plate on car nd drove it with me to my house... while he parked it i noticed a big dent in front bumper so i touched it and pain was wet... i instantly told him i didn want the car one hour after puchase... tey told me they were closing in five minutes and to call them monday mornand theyd refund it... monday comes and theysay we wont give you a refund they say we will give you 500 dollars back for car but we are takin away your 30 day warranty and your getting car as is !!!! i replied no i dont want the car refund te money and they refsed and tld me to take it to court... i haea newborn andno vehicle so i took the car and signed a paper saying im taking the car as is cause i had no choice i dont hav months to wait to fet my 5500 back for a new car .... i registered the vehicle and insured the car and got a sticker now the day after i got the sticker the chck engine light came on and the cars makin funny noises!!!! what can i do ive owned the car for 3 days and they ar srewing me!! i live in massacusetts and was told you cant get a ca from a dealership as is under used car warranty law in massachusetts if it over 700 dollars and under 125000miles you get 30 days under the implied warrant of merchantibilty... what options do i have in mass legally i was also tol any car in mass under 125k and ovr 700dollars has to com with a warranty and they didntgive me one what can i do i now have a car with dented hood and check engine light on all becase of them the hoods messed up and now the check engine light is on and its making noise ??? what can i do to get this fixed by mass law or can i get a refund its been 3 or 4 days since i bought it ????
after i saw the dent and wet paint they gave me 500 dollars back and made me sign something that i would have to take the car as is ! now in massachusetts it says there is no such thing as as is ! it goes onto say certaint cars have autom atic warranties for certain amount of time ! any ways i went to get an oil change now and have them inspect it and the place refused to even change the oil car the car was rapping! i called the place they said i bought the car as wholesale after they refunded the 500 and that there not going to give me a trade in or repair anything! no what do i do ?
